“E-Moto” Bikes at Seacliff
There have been ongoing instances of people riding “e-moto” bikes inside Seacliff common areas and on private property. Our security team has been facing challenges in dealing with this problem, and we have received numerous calls from concerned property owners.

“E-moto” trespassing on private and public lands affects many communities around Kauai and Hawaii. Presently, there are no specific laws regulating the use of electric bikes on private property (regular bicycles are regulated). E-bike regulations are apparently being discussed at the state level, but as of this writing, e-bikes remain unregulated.
The original Seacliff subdivision approval clearly states that there should be no entry or exit except through the front gate. The law prohibits trespassing on private property, and the best current method of dealing with e-moto bikes is to treat them as trespassers.
During our discussions with the Kauai Police Department, they suggested the following:
Post private property signs at entry points to your property.
Obtain documentation when someone is trespassing on your property (Ginny this needs clarification - photos, form???)
Prevent entry. This can be done via fencing or other barriers to entering on your property.
We are pleased to report excellent cooperation from property owners and Fish and Wildlife. Our management team is addressing this issue by actively monitoring points of entry into Seacliff and working with property owners to strengthen their property lines along the boundaries of Seacliff.
The primary objectives at this point are to monitor and close points of entry, post “no trespassing” signage, and to document trespassing incidents.

Our security guards are not authorized to enter private property, as our contract is limited to protecting the common areas. However, we are always willing to discuss ways to enhance security with property owners.
